Informative Restraining Order/Domestic Violence Advice

Under Illinois domestic violence laws, spouses, children, former partners, family members, or housemates can seek protection from abuse by filing for a restraining order. Domestic abuse involves physical abuse as well as harassment, emotional/psychological abuse, intimidation, and other forms of abuse. Victims of abuse may submit an immediate petition for an order of protection - which occurs without the other person present.

Restraining orders and orders of protection are temporary until a hearing is held (within 2 days to three weeks). However, they can have a grave impact on the entire family. Temporary protection orders can result in the person filing for protection being granted the following:

  • Exclusive possession of the home or residence
  • Immediate possession of the children (temporary child custody)
  • Temporary child support payments
  • Temporary spousal maintenance payments
  • Return of specific property

Individuals served with a restraining order have a right to a hearing within three weeks. However, with the help of an experienced lawyer, this hearing can be expedited to two days from the issuance of the restraining order. At this hearing, it will be determined if the restraining order should be dismissed or honored - and extended up to two years.
